These Terms govern all sales of goods to customers (“you”) worldwide through our website or by direct order.
2. Where These Terms Apply
These Terms apply to all orders wherever you are based, including the United Kingdom, European Union, United States, Canada, and other international destinations.
Local mandatory consumer rights still apply and take precedence where required by law.
⚖️ If any clause in these Terms conflicts with mandatory consumer law in your country or state, that local law will prevail.
3. Pre-Contract Information
Before you place an order, we will make clear:
-
Our business identity, contact details, and trading name
-
Description of the goods, including materials and condition (especially for vintage or restored items)
-
Total price including delivery, taxes, and any additional charges
-
Delivery arrangements and estimated timeframes
-
Payment methods accepted
-
Your right to cancel (if applicable) and any exceptions
-
Who pays for returns
-
How to make complaints or contact us
By placing an order, you confirm that you have read and accepted these Terms.
4. Contract Formation
-
When you place an order, you are making an offer to purchase.
-
We will acknowledge your order by email. This does not mean it has been accepted.
-
The contract is only formed when we send a Dispatch Confirmation.
-
We may decline or cancel any order before dispatch (for example, due to stock unavailability, pricing errors, or payment issues).
5. Prices, Taxes & Import Duties
-
Prices are listed in GBP (£).
-
UK customers: Prices include VAT (where applicable).
-
EU customers: Prices may include or exclude local VAT, depending on your country’s import rules. You may be responsible for import VAT or duties upon delivery.
-
US & Canadian customers: Prices exclude local taxes, import duties, or brokerage fees — these may be charged by customs and are your responsibility.
-
We are not responsible for customs delays, local import restrictions, or any duties charged by your country’s authorities.
We recommend checking your local import regulations before ordering.
6. Payment
We accept:
-
Credit / Debit Cards (Visa, MasterCard, American Express)
-
PayPal
-
Bank Transfer (by prior arrangement)
Full payment is taken at the time of order unless otherwise agreed. Orders will not be dispatched until payment has cleared.
7. Delivery, Risk & Title
-
We ship worldwide. Estimated delivery times and costs are provided at checkout.
-
Delivery dates are indicative and not guaranteed; delays can occur due to customs or international transport.
-
Risk in the goods passes to you when the goods are delivered to your address.
-
Title (ownership) passes only once we have received full payment.
If you refuse delivery or provide incorrect address details, you may be liable for re-delivery charges or loss.
8. Right to Cancel (UK & EU Consumers)
You have a legal right to cancel most orders within 14 days without giving any reason.
-
The cancellation period ends 14 days after you (or a nominated person) receive the goods.
-
To cancel, email us at [Insert email] with your order number and clear notice of cancellation.
-
You must return the goods within 14 days of notifying us.
-
You are responsible for return shipping costs unless goods are faulty or not as described.
-
Refunds include the standard delivery cost (but not extra paid for express delivery).
We will refund within 14 days of receiving the goods back or receiving proof of return — whichever is sooner.
9. Exceptions to Cancellation
The right to cancel does not apply to:
-
Goods made to your specifications or clearly personalised
-
Goods that are sealed and cannot be returned for hygiene reasons once unsealed
-
Goods that by nature cannot be returned (e.g., perishable or custom-restored items)
-
Goods mixed inseparably with others after delivery
Example: a chair re-upholstered to your custom fabric choice cannot be cancelled once production begins.
10. Returns for Faulty or Damaged Goods
If your goods arrive damaged, incorrect, or faulty, contact us within 48 hours of delivery with photos.
You have statutory rights to a repair, replacement, or refund under the UK Consumer Rights Act 2015 or equivalent laws in your jurisdiction (such as the EU Sale of Goods Directive, U.S. Magnuson-Moss Warranty Act, and Canadian Consumer Product Warranty Acts).
We will cover return or replacement costs if the goods are defective or not as described.
11. Business Customers (Trade & Wholesale)
-
Cancellation rights do not apply to business-to-business (B2B) transactions.
-
Any claim for non-delivery, damage, or defect must be made in writing within 7 days of delivery.
-
Our total liability to business customers shall not exceed the price of the goods in question.
12. Product Description & Quality
-
Each item’s description, images, and dimensions are given in good faith.
-
Many products are vintage, restored, or hand-finished, meaning natural variations and minor imperfections are normal.
-
Colour or grain variations may occur due to natural materials and screen differences.
-
These variations are not defects.
13. Limitation of Liability
Nothing in these Terms excludes or limits liability for:
-
Death or personal injury caused by our negligence
-
Fraud or fraudulent misrepresentation
-
Any other liability that cannot legally be excluded
To the fullest extent permitted by law:
-
We are not liable for indirect or consequential losses (e.g., loss of profit, opportunity, or enjoyment).
-
Our total liability for any claim will not exceed the total amount paid for the goods in question.
Your statutory rights remain unaffected.
14. International Consumers (U.S. & Canada)
-
U.S. and Canadian consumers’ rights vary by state or province.
-
You may have additional protections under local “lemon laws”, implied warranties, or unfair trade practice laws.
-
Nothing in these Terms overrides those mandatory local rights.
Where allowed by law, disputes will be governed by English law, and you agree that UK courts shall have jurisdiction.
However, local mandatory consumer rights (e.g., warranty periods, cancellation rights) will still apply.
15. Force Majeure
We are not liable for delays or failures caused by events beyond our control — including strikes, extreme weather, war, or customs delays.
If such events continue for over 30 days, either party may cancel the order, and any pre-payment will be refunded for undelivered goods.
16. Data Protection & Privacy
We comply with the UK GDPR, EU GDPR, and other applicable data laws.
Personal information is collected only to process and deliver your order, and never sold or shared with third parties without your consent.
For full details, please read our Privacy Policy [link].
17. Intellectual Property
All text, designs, and images on our website are our property or used under licence.
You may not reproduce, copy, or use any material without written permission.
18. Governing Law & Jurisdiction
-
UK & EU consumers: governed by the laws of England and Wales. You may bring legal proceedings in your local courts or in England and Wales.
-
U.S. & Canadian consumers: governed by English law to the extent permitted, but you retain any non-waivable consumer rights under your own state or provincial law.
-
Business customers: exclusive jurisdiction of the courts of England and Wales.
19. Complaints & Contact
We aim to resolve any issue quickly and fairly.
-
Email: [Insert email]
-
Telephone: [Insert number]
-
Address: [Insert full postal address]
We respond to complaints within 14 days.
If you’re a UK or EU consumer and remain unsatisfied, you may refer the matter to an Alternative Dispute Resolution (ADR) provider or the Online Dispute Resolution (ODR) platform (ec.europa.eu/consumers/odr).
